Reminder: Nominee Policy

Access Canberra inspectors have the power to conduct inspections including for the purpose of checking compliance with legislative requirements and standards. This is a timely reminder that, under section 28(d) of the Constructions Occupation (Licencing) Act 2004 (ACT) it is a requirement for all members who hold a building licence to have a written record of policies and procedures for effectively managing and supervising the nominee and the corporation’s or partnership’s obligations under the licence, including arrangements for communicating regularly with the nominee in relation to the construction services provided by the corporation or partnership.  It is important to make sure that your policies and procedures are implemented in practice and are reviewed regularly to ensure the effectiveness of the system in place.

This document is a general guide only and should be prepared in consultation with the nominee/s and tailored to suit the company or partnership’s operations.
