Practical Completion under the MBA Lump Sum Residential Building Contract

The ACT Home Building Contract has now been updated and replaced with the ACT Lump Sum Residential Building Contract.

The former contract contained an ambiguity regarding the calculation of the date for practical completion, in particular, clause 10.  Whilst there is no requirement to enter into a new contract if you already have a contract on foot, you may wish to put your client on notice to address the ambiguity which relates to the calculation of the date for practical completion.  To assist, we have a template available which can be completed and issued to your client/s to remedy the ambiguity.

The updated version of the ACT Lump Sum Residential Building Contract is now available through eDocs or for purchase at the MBA ACT office (hard copy only).
