Build what’s approved, not what’s convenient

Across recent projects and compliance audits, we continue to see issues where construction deviates from the approved plans without the necessary approvals in place. While some changes may appear minor or practical at the time, unapproved variations can create significant regulatory, contractual, and financial risk.

Why this matters

Building Approval (BA) documentation is not a guide — it is a legally approved set of documents that your project must follow. Any departure from these plans, unless formally approved, can result in:

  • Non-compliant building work under the Building Act 2004 (ACT)
  • Delays to Certification of Occupancy and Use (COU)
  • Rectification orders or enforcement action from Access Canberra
  • Exposure to defects and warranty claims
  • Insurance and Fidelity Fund complications, particularly where work differs from what was certified

Common problem areas we’re seeing

  • Structural changes (beam sizes, footing systems, drop edges) made on-site
  • Window and door substitutions without updated compliance evidence
  • External cladding changes that encroach on the building envelope
  • Changes to components of the building due to subcontractor constraints
  • Builder-driven improvements that were not documented or approved

 

Even well-intentioned changes can undermine performance solutions, engineer designs, or compliance pathways under the NCC.

What you should be doing

  • Build strictly in accordance with the approved plans and specifications
  • Where changes are required, seek updated approvals before proceeding
  • Engage the relevant design consultants (engineer, architect, certifier) early
  • Maintain clear records of all approved variations
  • Ensure subcontractors are working off the current approved documentation
