Your Right to Freedom of Association

Freedom of Association is simply the right to:

  • choose whether to join or not join a union or for employers, an employer association; and
  • protection from discrimination or victimisation as a result of your choice to, or not to, be a member of a union or employer association.

These rights of association are extended to employees, employers, as well as independent contractors.

If you are a Code Certified Entity under the ACT Secure Local Jobs Code, you have the obligation to ensure that your workers are aware of their rights to freedom of association. It is a good practice that members provide information about freedom of association as part of their induction process for any new workers. Members can also reinforce this information in toolbox talk or other forms of communication when necessary.
