URGENT FEEDBACK REQUIRED – How Proposed Changes to Annual Shutdown Arrangements May Impact your Business!!


The Fair Work Commission wants to make changes to the rules contained within awards that may prevent you from being able to shut down your business over the Christmas/New Year period.  Modern Awards that are to be affected by these changes will include the Building and Construction General On-Site Award 2020 [MA000020] and the Joinery and Building Trades Award 2020 [MA000029].  Currently, these Awards allow for an annual close-down (shutdown) provided certain obligations are met but also allows for agreements to be reached where an employee may not have sufficient paid leave entitlements to cover the close-down period.  These changes, if implemented, will remove this flexibility and historic arrangement.

It is MBA’s position that the proposed changes are not reasonable nor feasible, particularly in circumstances where employees have insufficient or no accrued annual leave to cover the full period of closing.  Your views and responses are important in assisting MBA argue against any unfavourable changes for our industry.  Please note that this survey closes on Monday 14 November 2022.
