Key changes under the Building and Construction Legislation Amendment Act 2025

The Building and Construction Legislation Amendment Act 2025 has come into effect on 1 April 2025 and introduces key amendments across several Acts and Regulations. Some of the relevant amendments are listed below: 

  1. Building Act (ACT) 2004 (Building Act)
  • ACT Appendix to the Building Code: The ACT Appendix to the Building Code will no longer be automatically published. Members will need to regularly check the ACT Legislation Register for updates. 
  • Access to the Building Code: The Construction Occupations Registrar is no longer required to keep a copy of the Building Code. Please ensure your team has access to the latest version through alternative platforms or subscriptions. 
  • Recognised Standards: The Minister may now declare certain eligible documents to be a recognised standard for the Building Act. These documents will only be enforceable if made accessible by publication.  
  1. Building (General) Regulation 2008
  • Energy Efficiency Certificates: The Whole-of-Home Calculator must now be used to assess energy efficiency. This tool, published by the Australian Building Codes Board, is accessible here. 
  1. Construction Occupations (Licensing) Act 2004
  • New Licensed Role: A new licensed role, “gas appliance worker,” has been introduced. 
  • Gas Appliance Workers’ Retroactive Validation: Work carried out by gas appliance workers between 29 March 2015 and 1 April 2025 is now considered legally valid under certain circumstances, even if the work did not comply with the updated rules at the time.
