Members are reminded that changes to the entry permit holder powers under the ACT WHS legislation came into effect from Monday 7 September 2020.
This change allows an entry permit holder to now record (audio, visual, photograph or other) when investigating a suspected WHS breach. The entry permit holder is required to notify you of its intention to record. It is important that you are aware of your rights and obligations when it comes to right of entry.
Penalties apply where a person is found to have refused entry to site or hindered or obstructed an entry permit holder from carrying out their functions.
