Fair Work Commission Statement about Process to Include a Right to Disconnect Term in Modern Awards

The Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024 amended the Fair Work Act 2009 to create a formal workplace right that allows employees to disconnect from work outside of their usual work hours. This new right to disconnect will start on:

• 26 August 2024 for non-small business employers; and
• 26 August 2025 for small business employers.

The Fair Work Commission has issued a statement setting out a final timetable for a process to include a right to disconnect terms in modern awards. The Statement can be accessed here.
