Am I required to notify a union when I commence bargaining for an enterprise agreement?

If you are a Secure Local Jobs Code certified company and you are either thinking about commencing bargaining for a new enterprise agreement or about to commence a new round of bargaining, you are required to:

  • invite the employees who will be covered by the enterprise agreement and the eligible union(s) to attend a meeting; and
  • allow the invited employees and the eligible union(s) to attend and participate in the meeting; and
  • at the meeting, make the employees aware of their rights of representation in enterprise bargaining.

An employer may also be required to notify a union if they hold an existing enterprise agreement that requires them to notify the union for bargaining of a new agreement.
