ACT Home Building Contract – When Can the Progress Payment be Claimed and When Does it Become Due and Payable?

Over the last few weeks, the Industrial Relations and Legal Team have received a number of queries from members relating to progress payments under the ACT Home Building Contract (the Contract).  

Clause 22(d) of the Contract provides that,  

Progress payment claims will be payable upon the completion of each stage of the Works and at the relevant values stated at Appendix B, Item B1, despite any minor omissions and/or minor Defects which do not prevent the Works from progressing to the next stage’. 

 

Progress payments must be made by the client within the timeframe specified in the contract.
