As members would be aware, the Fair Work Commission made a Road Transport Contractual Chain Order for fuel recovery order (RTCCO) effective 21 April 2026 to address the fuel supply chain disruption resulting from the Middle East conflict, and resulting increases.
What does the RTCCO say:
Under clause 4 of the RTCCO, primary and secondary parties to a covered agreement are required to perform two monthly reviews of paid rates and make necessary adjustments to provide for the recovery of increases. This obligation would cease if the price of diesel fell below $2.00 per litre, as reported by the Australian Institute of Petroleum (AIP).
Changes effective 5 June 2026:
The AIP reported that the weekly national average terminal gate price of diesel for the week ending 5 June 2026 was 189.70 cents, the first time falling below $2.00 since 21 April 2026.
Consequently:
Parties are still able to recover costs, or pursue payments, pursuant to adjustments made before the week ending 5 June 2026.
Parties seeking to pursue an outstanding claim under the RTCCO should first determine whether that claim meets the eligibility period of 21 April 2026 to 7 June 2027.
