Property Developers Act 2024 reminder

The Property Developers Act 2024 (‘Act’) establishes a licensing and regulatory framework for residential property developers in the ACT, ensuring competence, accountability, and public confidence.

The Act was passed by the ACT Legislative Assembly on 27 June 2024 and commenced on 23 February 2026. Its primary purpose is to regulate residential development activities by property developers, particularly for projects involving three or more residential dwellings.

The Act does not apply to single dwellings or dual occupancies.

Transition Period – a 12-month transition period applies, with mandatory licensing effective from 1 October 2026. Developers engaged in residential projects with three or more dwellings are strongly encouraged to apply early to ensure compliance by this date.  Please note the process to obtain a license will take an amount of time process according to the ACT Government.
