Focus on construction industry: heightened risk of fall non-compliance

The latest compliance and enforcement data for December 2025 underscores a critical concern for the construction sector falls from height remain a leading area of non-compliance. Workplace visits (WPVs) and enforcement actions reveal that construction continues to dominate in both improvement and prohibition notices, signalling persistent gaps in safety practices.

Key infringements were primarily issued under WHS Regulation s79(2), which mandates specific requirements to minimize the risk of falls, and s225(5) relating to scaffolding standards. Alarmingly, 80% of infringement notices targeted fall prevention measures, highlighting that despite ongoing awareness campaigns, compliance remains inconsistent.

This trend is not just a regulatory issue—it’s a serious safety risk. Falls from height are among the most severe hazards in construction, often resulting in life-altering injuries or fatalities. The data reinforces the need for robust risk assessments, proper use of fall protection systems, and strict adherence to scaffolding requirements.

Action Steps for Members

To strengthen compliance and protect workers, members should:

  1. Review Fall Prevention Plans
    Ensure your Safe Work Method Statements (SWMS) include detailed fall prevention strategies for all tasks involving heights.
  2. Inspect and Maintain Equipment
    Regularly check scaffolds, ladders, and fall arrest systems for defects. Replace or repair immediately if issues are found.
  3. Verify Training and Competency
    Confirm all workers have up-to-date training on working at heights and using fall protection equipment.
  4. Conduct Site Audits
    Schedule frequent inspections to identify hazards and verify compliance with WHS Regulation s79(2) and s225(5).
  5. Engage Supervisors and Workers
    Foster a safety culture by encouraging reporting of hazards and reinforcing the importance of compliance during toolbox talks.
