Understanding Residential Warranty periods in the ACT

Residential building work in the ACT is protected by statutory warranties under the Building Act 2004 (ACT) and the Building (General) Regulation 2008 (ACT). These warranties apply automatically to every residential building contract.

 

 90-Day Defect / Maintenance Period

  • Applies only if stated in the building contract (e.g. MBA Residential Contract).
  • Starts from practical completion.
  • Covers minor defects and adjustments as the home settles — paint touch-ups, sticking doors, cosmetic items.

 

2-Year Statutory Warranty — Non-Structural Defects

  • Applies to any defect not affecting structural integrity.
  • Covers finishes, fittings, waterproofing (if not impacting structure), window/door adjustments.
  • Starts from the completion day of the work

 

6-Year Statutory Warranty — Structural Defects

  • Applies to defects that affect building stability, structural performance, or liveability.
  • Includes foundation issues, major framing faults, roofing and waterproofing failures.
  • Starts from the completion day of the work.
