With winter’s wet weather upon us, builders are reminded and encouraged to claim extensions of time under their building contracts for inclement weather. This includes where inclement weather prevents access to site or introduces work health and safety issues.
Where an EOT is not issued correctly or within the required time, a builder may potentially be liable for liquidated damages under the contract.
