Bargaining Update: New Protected Action Ballot Agent Approved

The Fair Work Commission has approved a new eligible protected action ballot agent:
Lumi Technologies Pty Ltd – [2025] FWC 1900. 

Protected action ballots can only be conducted by: 

• The Australian Electoral Commission (AEC), or 

• A Fair Work Commission-approved protected action ballot agent. 

If the AEC conducts the ballot, the government covers the cost. If another approved agent is used, the applicant must pay. 

Why This Matters: 

If you are bargaining or considering protected industrial action, it’s essential to: 

• Understand who can conduct a ballot. 

• Factor in potential costs if using a non-AEC agent. 

• Engage only with listed eligible agents.
